These general terms and conditions apply to all treatments and services of DentalZorg Tandheelkunde.
Article 1 — Definitions
In these general terms and conditions, the following definitions apply:
- DentalZorg: DentalZorg Tandheelkunde, established at Rustenburg 118, 1506 AT Zaandam, registered with the Chamber of Commerce under number [kvk-number].
- Patient: the natural person who makes use of or has made use of the services of DentalZorg, or on whose behalf a treatment is requested.
- Treatment: all dental or related actions performed by or on behalf of DentalZorg.
- Healthcare provider: the BIG-registered dentist, dental prosthetist, dental hygienist or anaesthesiologist employed at DentalZorg.
- Agreement: the treatment agreement within the meaning of Article 7:446 DCC (WGBO) concluded between DentalZorg and the patient.
Article 2 — Applicability
2.1 These general terms and conditions apply to all offers, quotations, treatment agreements and other legal relationships between DentalZorg and the patient, unless otherwise agreed in writing.
2.2 Deviations from these conditions are only valid if expressly agreed in writing.
2.3 For minor patients (under 16 years of age), consent for treatment must be given by the parent(s) or legal representative(s).
Article 3 — Treatment Agreement
3.1 The treatment agreement is concluded when the patient consents to the proposed treatment, either verbally or by signing a treatment plan or consent form.
3.2 DentalZorg only performs treatments for which the healthcare provider is authorised and competent in accordance with the BIG Act.
3.3 The patient is obliged to fully and truthfully inform DentalZorg prior to treatment about their medical history, medication use, allergies and other medically relevant circumstances.
3.4 DentalZorg has the right to refuse or discontinue a treatment if this is medically justified in professional opinion, or if the patient does not meet the conditions set by DentalZorg.
Article 4 — Appointments and Cancellation
4.1 Appointments can be made by telephone, email or the contact form on the DentalZorg website.
4.2 The patient must cancel or reschedule an appointment at least 48 hours in advance. In the event of late or no cancellation, DentalZorg reserves the right to charge for the reserved treatment time.
4.3 For treatments under general anaesthesia, a cancellation period of 5 working days applies, given the special preparation and deployment of anaesthesia staff.
4.4 DentalZorg reserves the right to cancel or reschedule appointments in the event of illness of the treating dentist or force majeure. The patient will be informed as soon as possible and a new appointment will be scheduled in consultation.
Article 5 — Rates and Payment
5.1 DentalZorg rates are based on NZa rates (Dutch Healthcare Authority) and are available through the practice on request.
5.2 After each treatment the patient receives an itemised invoice. Payment must be made within 14 days of the invoice date, unless otherwise agreed.
5.3 In the event of late payment, the patient is automatically in default and DentalZorg is entitled to charge statutory interest from the due date.
5.4 In the absence of payment, collection costs will be charged in accordance with the Decree on compensation for extrajudicial collection costs.
5.5 For treatments under anaesthesia, DentalZorg may require a deposit.
Article 6 — Insurance Reimbursement
6.1 Whether and to what extent treatments are reimbursed depends on the patient's health insurance. DentalZorg advises the patient to consult their own policy prior to treatment.
6.2 DentalZorg invoices directly to the health insurer where possible. Any excess or non-reimbursed costs are borne by the patient.
6.3 Non-reimbursement or partial reimbursement by the health insurer does not relieve the patient of their payment obligation to DentalZorg.
Article 7 — Liability
7.1 DentalZorg provides care in accordance with the standards and guidelines applicable to the profession (best efforts obligation). DentalZorg does not guarantee a specific treatment result.
7.2 DentalZorg is insured for professional liability. Liability is limited to the amount paid out by the liability insurance in the relevant case.
7.3 DentalZorg is not liable for damage resulting from the provision of incorrect or incomplete information by the patient, or failure to comply with instructions given.
Article 8 — Complaints and Disputes
8.1 DentalZorg values your satisfaction highly. Complaints about treatments or services can be reported via [email protected] or by telephone on 088 252 3800.
8.2 DentalZorg aims to respond to your complaint within 5 working days.
8.3 If you cannot resolve the matter with DentalZorg, you can contact:
- Klachtenportaal Zorg — for independent complaint mediation (klachtenportaalzorg.nl)
- KNMT complaints procedure — via the Royal Dutch Dental Association
- Geschilleninstantie Mondzorg — for binding rulings (geschilleninstantiemondzorg.nl)
8.4 Dutch law applies to the agreement. Disputes are submitted exclusively to the competent court in the Noord-Holland district.
Article 9 — Personal Data
9.1 DentalZorg processes personal data in accordance with the General Data Protection Regulation (GDPR). For more information please refer to our Privacy Policy.
9.2 The medical file is retained in accordance with the WGBO for a minimum of 20 years.
Article 10 — Amendments
10.1 DentalZorg reserves the right to amend these general terms and conditions. Changes will be communicated in a timely manner via the website or by email.
10.2 In the event of substantial changes, the patient will be notified. Continued use of the services after the changes have been announced constitutes acceptance.
